Terms of Service
These Terms of Service (“Terms”) govern your access to and use of the viewio macOS application, the viewio website, and related materials (together, the “Services”). By downloading, installing, or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
1. Who we are
viewio is an open-source screen recording product for macOS. Source code, issues, and releases are available on GitHub.
2. Eligibility
You must be able to form a binding contract under applicable law and meet any minimum age required in your jurisdiction. If you use the Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
3. The Services
viewio lets you capture screen content and optional microphone, system audio, and camera input, then edit and export recordings on your device. Features may change over time. We may add, modify, or remove functionality, including free or paid offerings, without prior notice, except where the law requires otherwise.
4. Open-source software license
The viewio application source code is distributed under the open-source license published in the project repository. That license controls your rights to the source code, copies, and modifications. These Terms apply to your use of the Services and website in addition to any applicable open-source license. If there is a direct conflict between an open-source license grant and these Terms regarding the licensed source code, the open-source license controls for that code.
5. Your responsibilities
You agree that you will:
- Use the Services only in compliance with applicable laws and these Terms;
- Obtain any consents and rights needed before recording other people, third-party content, or confidential information;
- Not use the Services to capture, distribute, or exploit content in a way that infringes privacy, intellectual property, or other rights;
- Not attempt to disrupt, reverse engineer (except where permitted by law or an open-source license), or misuse the website or distribution infrastructure;
- Not use the Services for malware, unauthorized surveillance, harassment, fraud, or other harmful activity.
You are solely responsible for your recordings, exports, and how you share them. Screen recording can capture sensitive information; handle outputs carefully.
6. Accounts and third-party services
viewio does not require a viewio account for core local recording and editing. Downloads, community spaces, and social links may involve third parties (for example GitHub, Discord, Telegram, or X). Those services are governed by their own terms. We are not responsible for third-party services.
7. Intellectual property
Except for open-source components licensed separately, the viewio name, branding, website design, and other materials we provide are owned by us or our licensors. You may not use our trademarks in a way that suggests endorsement without permission. Your own recordings remain yours, subject to rights of others whose content or likeness appears in them.
8. Privacy
Our collection and use of information is described in our Privacy Policy. By using the Services, you acknowledge that policy.
9. Disclaimers
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS, OR THAT RECORDINGS WILL MEET YOUR QUALITY OR LEGAL REQUIREMENTS.
Some jurisdictions do not allow certain disclaimers. In those places, disclaimers apply to the maximum extent permitted by law.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, VIEWIO AND ITS CONTRIBUTORS, OPERATORS, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICES IN THE TWELVE MONTHS BEFORE THE CLAIM, OR (B) FIFTY U.S. DOLLARS (US $50).
11. Indemnity
You will defend and indemnify viewio and its contributors and operators against claims, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Services, your recordings or content, or your violation of these Terms or third-party rights, to the extent permitted by law.
12. Termination
You may stop using the Services at any time by uninstalling the app and ceasing use of the website. We may suspend or terminate access to the website or distribution of builds if you violate these Terms or if we discontinue the Services. Provisions that by their nature should survive (including disclaimers, limitations of liability, and indemnity) will survive termination.
13. Changes to the Terms
We may update these Terms from time to time. The “Last updated” date will change when we do. If you continue using the Services after updated Terms are posted, you accept the changes, except where applicable law requires additional consent.
14. Governing law
These Terms are governed by the laws applicable in the jurisdiction where the primary operator of the viewio project resides, without regard to conflict-of-law rules, except where mandatory consumer protection laws of your country of residence apply. Courts in that jurisdiction will have exclusive venue for disputes, except that you may have non-waivable rights to bring claims in your local courts if you are a consumer.
15. General
These Terms are the entire agreement between you and us regarding the Services and supersede prior agreements on that subject. If a provision is unenforceable, the remaining provisions remain in effect. Failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a reorganization or transfer of the project.
